What is a Chapter 13 Bankruptcy?
Also called a “Debt Reorganization Plan” Chapter 13's are designed to help you reorganize your debt over a 3-5 year period. They are especially helpful if you have filed a Chapter 7 in the past 8 years, getting garnished, have secured debts you are behind in payments, or if you have property that wouldn't be protected in a Chapter 7
Eliminate a good portion of debt
Payments in a Chapter 13 are based on your ability to pay. Sometimes, there are plans where you pay pennies or less on the dollar of debt owed. When you come in to meet with one of our attorneys, we will discuss your financial situation. It is also possible to eliminate a second or third mortgage if you owe more on the first mortgage than the house is worth. You may also be able to lower the interest rate on your vehicles or pay just what the vehicle is worth and not what you owe. Pay one payment with little money to file
File your case with little or no money down
The majority of our Chapter 13 cases are filed with just the filing fee. The balance is paid through your bankruptcy payment. We agree to do that because we want your bankruptcy to succeed. With a Chapter 13, you make one payment to a Bankruptcy Trustee who then distributes the funds. When you come in for your initial consultation, the attorney will discuss an estimated payment and walk you through the Chapter 13 process.
